Terms of sale

These terms of sale are concluded on the one hand by the individual company “THIBAULT WITTEMBERG” registered under the SIREN number: 537428401, hereinafter referred to as “the seller”, and managing the site www.carbonestellaire.fr and, on the other hand, by any natural or legal person wishing to make a purchase via the website www.carbonestellaire.fr hereinafter referred to as “the buyer”.

Article 1. Purpose

These terms of sale aim to define the contractual relations between the seller and the buyer and the conditions applicable to any purchase made through the website www.carbonestellaire.fr. The acquisition of a product through this site implies unconditional acceptance by the buyer of these terms of sale, which the buyer acknowledges having read prior to placing his order. Before any transaction, the buyer declares on the one hand that the purchase of products on the site www.carbonestellaire.fr is not directly related to his professional activity and is limited to strictly personal use and on the other hand to have full legal capacity, allowing him to commit to these general conditions of sale.

The seller reserves the right to modify these conditions of sale at any time, in order to comply with any new regulations or in order to improve the use of its site. As a result, the applicable conditions will be those in force on the date of the order by the buyer.

Article 2. Products

The products offered are those that appear on the site www.carbonestellaire.fr, within the limit of available stocks. The seller reserves the right to modify the product assortment at any time. Each product is presented on the website in the form of a description including its main technical characteristics. The photographs are as faithful as possible but do not bind the seller in any way. The sale of the products presented on the site www.carbonestellaire.fr is intended for all buyers residing in countries that fully authorize the entry of these products into their territory.

The products are knives made using artisanal methods, such as forging.

The pieces sold on this site are made by hand, with natural materials (such as wood). They may therefore have some imperfections related to their manufacturing methods. Although the site displays the pieces with photos and detailed descriptions, these imperfections may be discovered upon receipt and are an integral part of the identity of the piece as a unique artisanal creation.

The seller advises not to expose his creations to excessive heat at the risk of seeing certain materials age, deform or crack (for example if the piece remains behind a car windshield in direct sunlight). It is preferable to store them away from dust, humidity and direct sunlight.

In order to maintain good cutting properties, the blade must be sharpened regularly. The buyer may, for example, use a sharpening stone.

Knives should never be washed in the dishwasher, as they may be damaged by excessive temperatures or the water itself. They should be washed by hand and then dried immediately. For carbon steels (which can therefore oxidize), it is advisable to dry the blades thoroughly immediately after cleaning and to oil them before storing them in order to avoid premature oxidation.

The maintenance of wooden handles (to nourish them and protect them from wood-eating insects, or repeated washing altering the impregnation carried out in the workshop) can be carried out with a little linseed oil.

Article 3. Prices

The prices appearing on the product sheets of the online catalog and are prices in Euros (€) including all taxes (TTC) taking into account the VAT applicable on the day of the order. Any change in the VAT rate may be reflected in the price of the products. The seller reserves the right to modify its prices at any time, it being understood, however, that the price appearing in the catalog on the day of the order will be the only one applicable to the buyer. The prices indicated do not include delivery costs, invoiced in addition to the price of the products purchased according to the total amount of the order. The amount of the shipping costs is calculated on the basis of a fixed price established by the seller according to the cost of delivery as well as that of the packaging. For products shipped outside Metropolitan France, customs duties or other local taxes or import duties or state taxes may then be payable in certain cases. These duties and sums are not the responsibility of the seller.

They will be the responsibility of the buyer and are his responsibility (declarations, payment to the competent authorities, etc.).

The seller therefore invites the buyer to inquire about these aspects with the corresponding local authorities.

Article 4. Order and payment terms

Before any order, the buyer must create an account on the website www.carbonestellaire.fr. The account creation section is accessible directly from the side menu bar. At each visit, the buyer, if he wishes to order or consult his account (order status, profile, etc.), must identify himself using this information. The seller offers the buyer to order and pay for his products in several stages, with 3 payment options to choose from:

- Secure payment by Paypal or credit card: the buyer selects the products he wishes to order in the "basket", modifies if necessary (quantities, references, etc.), checks the delivery address or enters a new one. Then, the shipping costs are calculated and submitted to the buyer, as well as the name of the carrier. Then, the buyer chooses the payment method of his choice. The next step is to check all the information, read and accept these general terms and conditions of sale by checking the corresponding box, then invite him to validate his order by clicking on the "Confirm my order" button. Finally, the buyer is redirected to the secure interface in order to securely enter his payment information. If the payment is accepted, the order is registered and the contract is definitively formed. The payment is irrevocable. In the event of fraudulent use of the card, the buyer may demand cancellation of the card payment, the amounts paid will then be credited or refunded. The liability of the holder of a bank card is not incurred if the disputed payment has been proven to have been made fraudulently, remotely, without physical use of his card. To obtain a refund for the fraudulent debit and any bank charges that the transaction may have generated, the cardholder must contest the direct debit in writing with their bank within 70 days of the transaction, or even 120 days if the contract binding them to it provides for it. The amounts withdrawn are reimbursed by the bank within a maximum of one month after receipt of the written objection filed by the cardholder. No fees for the restitution of the sums may be charged to the cardholder.

Confirmation of an order implies acceptance of these conditions of sale, acknowledgement of having full knowledge of them and waiver of the right to rely on their own conditions of purchase. All data provided and the recorded confirmation will constitute proof of the transaction. If the buyer has an email address and has provided it on their order form, the seller will send them an email confirming that their order has been registered.

 Article 5. Retention of title

The seller retains full ownership of the products sold until full payment of the price, including principal, costs and taxes.

Article 6. Withdrawal

Under Article L121-20 of the Consumer Code, the buyer has a period of fourteen working days from the delivery of their order to exercise their right of withdrawal and thus return the product to the seller for exchange or refund without penalty, with the exception of return costs.

To be eligible for a return, your item must be in the same condition in which the buyer received it, unworn or unused, with the labels and in its original packaging.

Article 7. Delivery

The order will be sent between 1 and 7 days after receipt of payment for creations in stock.

For products made to order, a longer period will be necessary for manufacturing, varying according to the Seller's order book and the content of the project (project design, acquisition of raw materials, manufacturing, etc.).

For large numbers of or specific orders for which both parties have jointly established that they require many hours of work, additional manufacturing times may be necessary. The buyer will then be informed of this during their first exchanges with the seller.

Deliveries are made to the address indicated on the order form, which can only be in the agreed geographical area. Deliveries are made by external service providers such as La Poste.

For shipments to mainland France, 2 to 4 days are allowed for receipt from the shipping date. Once the package is in the hands of the carrier, the seller cannot be held responsible for any additional delivery time.

The seller reminds that when the buyer takes physical possession of the products, the risks of loss or damage to the products are transferred to him. It is up to the buyer to notify the carrier of any reservations about the product delivered.

Article 8. Warranty

All products supplied by the seller benefit from the legal warranty provided for by articles 1641 and following of the Civil Code.

In the event of non-conformity of a product sold, it may be returned to the seller who will take it back, exchange it or refund it. To be eligible for a refund or exchange, damaged parts must have been used in accordance with their characteristics and limitations and with the precautions for use explained in Article 2 of these general terms and conditions of sale. For example, a knife damaged following use as a lever or screwing tool will not be eligible for warranty coverage.

Article 9. Liability

The seller, in the distance selling process, is only bound by an obligation of means. Its liability cannot be incurred for damage resulting from the use of the Internet network such as loss of data, intrusion, virus, service interruption, or other involuntary problems.

Article 10. Intellectual property

All elements of the site www.carbonestellaire.fr are and remain the intellectual and exclusive property of the seller. No one is authorized to reproduce, exploit, or use for any purpose whatsoever, even partially, elements of the site whether in the form of a photo, logo, visual or text.

Article 11. Personal data

The seller undertakes to preserve the confidentiality of the information provided by the buyer, which he would be required to transmit for the use of certain services. Any information concerning him is subject to the provisions of Law No. 78-17 of January 6, 1978. As such, the Internet user has the right to access, modify and delete information concerning him.
